  What to do now

Whether the County Council realised the effects of all the appeals on farmers and landowners throughout the country remains, like much of this sad case, a mystery. Since the change of political complexion at County Hall, it could have been a good time for the new members to clear out this skeleton and take control of the officers. If you have walked the paths, seen the gates and feel that:

  • this has been a gross abuse of power by Somerset County Council
  • it is wrong to waste ratepayers' money in pursuing a non-existent highway obstruction
  • illegal and unethical to enter into secret indemnities to finance personal vendettas

then contact the following:

If you are a member of the Ramblers Association ask Janet Davis (Senior Policy Officer, email here) why they gave £5,500 and Kate Ashbrook (General Secretary, Open Spaces Society, email here) why they donated £10,000. Both sums paid to Mr Peter Kidner. Their replies could be interesting.

A 10 point summary
  1. There is now and never has been any impediment to walkers
  2. March 2002 S Somerset DC requested new five bar wooden gate and pedestrian gate be reversed: verbal authority given (complied with).
  3. May 2004 Following burglaries steel gates with side gate installed to keep in livestock
  4. May 2005 SCC issued s143 notice to remove gates
  5. June 2006 Yeovil Magistrate's Court issued absolute discharge, suggested manual handles on main gates (complied with)
  6. March 2007 SCC confirmed they will not be removing the gates
  7. October 2007 Mr Kidner sued SCC (not defended). Judgement given to remove all pillars and gates
  8. February 2008 SCC entered into secret indemnity to cover Mr Kidner's costs against him
  9. December 2008 SCC win appeal: Judge ordered just central pillar only to be removed
  10. Both sides lodge appeal: SCC to remove entire structure and not to pay costs, the Herricks for obvious reasons.
    February 17th 2010: High Court dismisses appeal, orders SCC to demolish entire structure.
